These Terms of Service ("Terms") govern your use of openearmedia.com and Open Ear Media applications that link to these Terms (the "Services"), operated by Open Ear Media ("we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services. Linked network products may have separate terms that apply to their use.

Using the Services

You may use the Services for lawful purposes and in accordance with these Terms. You must have the legal capacity to agree to these Terms or have permission from a parent or legal guardian, as applicable. You are responsible for your use of the Services and for information you submit.

You must not interfere with the Services, attempt unauthorized access, distribute malicious software, infringe others' rights, submit fraudulent or unlawful content, or bypass security or access restrictions.

Accounts and connected services

If a feature requires an account or connection to a third-party service, you are responsible for keeping your credentials secure and granting only permissions you intend to authorize. You may disconnect a Google integration through your Google Account permissions. Third-party services, including Google, are also governed by their own terms. We are not affiliated with or endorsed by Google merely because an application uses Google APIs.

Privacy

Our Privacy Policy explains how we handle personal information, including information from authorized Google integrations.

Our content and your submissions

Our branding, original content, designs, and software are owned by Open Ear Media or its licensors and are protected by applicable intellectual property laws. These Terms give you a limited, nonexclusive right to use the Services as intended, not ownership of our content. Third-party names, marks, music, streams, and event information belong to their respective owners.

You retain ownership of content you submit. You grant us permission to use that content only as needed to process your request, respond to you, and provide the relevant Service. You must have the rights necessary to submit it. This permission does not override the restrictions on Google user data described in our Privacy Policy.

Third-party links, streams, and events

The Services may link to external websites, broadcasters, event organizers, ticket sellers, and other providers. We do not control their content, availability, policies, or transactions. Event details, schedules, prices, and stream availability may change; verify important information directly with the provider. Unless expressly stated otherwise, we are not the organizer, broadcaster, or ticket seller.

Availability and changes

We may change, suspend, or discontinue features, or restrict access to prevent abuse, address security issues, or comply with law. We do not guarantee uninterrupted availability or that information will always be complete, accurate, or current.

Disclaimers

To the extent permitted by applicable law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and noninfringement. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

Limitation of liability

To the extent permitted by applicable law, Open Ear Media will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data, arising from your use of or inability to use the Services. Nothing in these Terms limits liability that cannot legally be limited or excludes your mandatory consumer rights.

Ending your use

You may stop using the Services at any time and revoke any connected-account permissions. We may suspend or end access for violations of these Terms or when reasonably necessary to protect the Services or others. For deletion requests, see our Privacy Policy.

Changes to these Terms

We may revise these Terms and will update the date above. We will provide additional notice of material changes when required by law. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.
